Participation in Swim-With-Me swimming lessons and membership is subject to acceptance of these Terms & Conditions.

We will use personal information provided by you for the purpose of delivering our services in accordance with the Swim-With-Me Privacy Policy.

These Terms & Conditions apply to both new and existing Swim-With-Me customers with a valid membership.

Our Service to You

Swim-With-Me will:

Provide swimming lessons delivered by STA or Swim England qualified swimming instructors using Swim-With-Me progressive tuition.
Provide tuition both in and out of the water as appropriate. Instructors may support swimmers in the water, including assisting body position and stroke technique where required.
Whenever reasonably possible, provide a temporary cover instructor when a regular instructor is absent.
Continually assess swimmers and recognise their progress through certificates and badges, which are available to purchase separately.
Endeavour to maintain appropriate class sizes. However, Swim-With-Me reserves the right to change the size or structure of lessons where necessary.
Provide an instructor and assistant combination where appropriate, although an assistant cannot be guaranteed.
Endeavour to provide continuity of lesson days, times and instructors, although these cannot be guaranteed.
Continue to provide water-based tuition wherever appropriate and practicable, although an instructor cannot be guaranteed to teach from within the water for every lesson.

Your Responsibilities

Parents, guardians and swimmers must:

Arrive at poolside no more than 5 minutes before the scheduled lesson.
Arrive on time. Swimmers arriving 10 minutes or more after the lesson has started will not be permitted to join, for health and safety reasons and to minimise disruption to other swimmers.
Remain away from poolside until called forward by the instructor or assistant.
Not approach poolside during a lesson unless asked to do so by an instructor or assistant.
Ensure swimmers and accompanying siblings do not walk or play around the perimeter of the pool.
Not interfere with or assist with the instruction of a swimmer during their lesson unless requested by the instructor.
Use the appropriate changing facilities provided and not change poolside.
Ensure a parent or guardian remains on the premises while a child is attending lessons.
Ensure non-swimmers wear armbands unless specifically advised otherwise by their instructor.
Provide any required buoyancy aids, including armbands, woggles and floats.

Required swimming equipment can also be purchased from Swim-With-Me as part of our New Swimmer Starter Pack.

Customers must also comply with the individual venue and Swim-With-Me Pool Rules.

Lesson Types

Swim-With-Me offers a range of lesson formats, which may include:

Exclusive Private 1:1 Lessons – one swimmer receiving exclusive tuition from an instructor.
Shared Private 2:1 Lessons – two swimmers sharing private tuition.
Shared Private 3:1 Lessons – three swimmers sharing private tuition.
Shared Private 4:1 Lessons – four swimmers sharing private tuition.
Small Group Lessons – small, supportive classes with a maximum number of swimmers as specified at the time of booking.

Lesson availability, class size and format may vary by venue.

Payments, Subscriptions & Online Purchases

Payments may be made securely online using the payment methods made available by Swim-With-Me.
All debit and credit card transactions are subject to validation and authorisation by the card issuer.
We accept major debit and credit cards, including American Express.
If a card issuer refuses to authorise a payment, Swim-With-Me will not be responsible for any resulting delay or inability to provide the service.
Payments must be made using a valid payment method authorised by the account or cardholder.
Swimming fees must remain fully up to date. For insurance and administrative purposes, swimmers may not participate where required payments are outstanding.
Specific lesson days and times are subject to availability and cannot be guaranteed indefinitely.
Continuity of instructors cannot be guaranteed due to sickness, holidays, staff changes or other unforeseen circumstances.
Active customers may be provided with access to Swim-With-Me online membership information.

Swim-With-Me uses Stripe Payments to process online card transactions.

Block Bookings

Block bookings are available for Small Group, Shared Private and Exclusive Private Lessons, subject to availability.

When purchasing a block:

You are committing to the full block of lessons purchased.
Lessons must be taken over consecutive Swim-With-Me teaching weeks in order to receive the advertised block saving.
Each registered swimmer is entitled to one scheduled lesson per teaching week, excluding scheduled Swim-With-Me breaks.
Unused lessons cannot normally be transferred, refunded or carried forward because of customer non-attendance.
Block bookings do not automatically renew.

To continue lessons and secure your existing swimming place, renewal is required at least 3 weeks before the end of your current block.

If renewal payment has not been received by this time, Swim-With-Me cannot guarantee that your existing place, day, time or instructor will remain available.

Monthly Auto E-Pay

Monthly Auto E-Pay allows eligible customers to spread the cost of lessons through monthly recurring payments.

Monthly Auto E-Pay has a minimum commitment of 6 months.
You may give 1 month's written notice during the minimum term, provided your cancellation does not take effect before the end of the 6-month minimum commitment.
After the minimum term, the agreement continues monthly until cancelled by giving 1 month's written notice.
Cancellation notice must be submitted using the Swim-With-Me Contact Leaver Form.
Your monthly payment amount is calculated by spreading the cost of your scheduled lessons across a 12-month period.
Payments are therefore collected every month, including during scheduled Swim-With-Me breaks.

If an E-Pay agreement ends part-way through the 12-month calculation period, the customer's account will be reconciled to reflect lessons and payments due up to the end of the applicable notice period.
Any required adjustment will be made to the customer's final payment.

Customer Non-Attendance

Swim-With-Me does not normally provide refunds or credits where a swimmer is unable to attend their scheduled lesson.

This includes non-attendance resulting from personal circumstances, holidays, illness, travel difficulties or other circumstances affecting the customer.

Where available and permitted under a specific Swim-With-Me product or policy, alternative arrangements may be offered at Swim-With-Me's discretion. This does not create an entitlement to a replacement lesson, refund or credit.

Lessons Cancelled by Swim-With-Me

Where Swim-With-Me cancels a scheduled lesson and is unable to provide the lesson:

Block Bookings

A credit will be provided by either:

extending the customer's current block; or
providing a replacement lesson on a day and time agreed between Swim-With-Me and the customer.

A replacement lesson may not be provided on the customer's normal day or time or with their usual instructor.

Monthly Auto E-Pay

Where appropriate, a credit will be refunded to the payment card held on the customer's account.

Credits issued as a result of a Swim-With-Me cancellation do not incur an administration processing fee.

Where a monetary refund or credit is due, please allow approximately 28 business days for processing.

Changes Requested by Customers

Requests to amend an existing booking are subject to availability.

Where an amendment is agreed, Swim-With-Me may charge a 20% administration processing fee.

A request to change a booking does not guarantee that an alternative day, time, venue or instructor will be available.

Cancelling Monthly Auto E-Pay

Notice to cancel a Monthly Auto E-Pay agreement must be submitted in writing using the Swim-With-Me Contact Leaver Form.

All payments due up to the end of the applicable minimum commitment and notice period remain payable.

Submitting notice does not automatically remove any outstanding balance already due under the agreement.

Lesson Availability and Changes

Swim-With-Me reserves the right, where reasonably necessary, to modify, suspend, relocate or cancel lessons or services.

Swimming days, times, venues and instructors are subject to availability and cannot be permanently guaranteed.

Where operational circumstances require a change, Swim-With-Me will endeavour to provide customers with appropriate notice wherever reasonably possible.

Swim-With-Me reserves the right to withdraw tuition where necessary, including where a swimmer does not comply with safety requirements.

Swimmers attending without appropriate swimwear or required buoyancy aids may be refused participation in the lesson without refund.

Promotional & Introductory Offers

Swim-With-Me may occasionally provide promotional or introductory offers.

Unless specifically stated otherwise:

New-customer promotional and introductory offers are available to new Swim-With-Me customers only.
Introductory offers apply only to the customer's initial booking with Swim-With-Me.
Introductory offers do not automatically apply to additional family members booked at a later date.
Promotional offers cannot be combined unless specifically stated otherwise.

Recommend a Friend

The Swim-With-Me Recommend a Friend offer:

Is available to current Swim-With-Me customers.
Applies where an existing customer's details are provided by the new customer at the time of their initial booking.
Becomes valid following the new customer's qualifying purchase and completion of the applicable block of swimming lessons.
Cannot be used alongside another Swim-With-Me promotional or introductory offer unless specifically stated otherwise.
Applies per customer rather than per swimmer.
Is not limited to one recommendation; customers may recommend multiple new customers.

Online Shop & Returns

If you are unhappy with a purchase from the Swim-With-Me online shop, unused and unworn items in their original packaging may be returned within 14 days.

Please include your Packing Note Number and advise whether you require a replacement or refund.

Where an item is faulty, Swim-With-Me will provide a replacement or, where preferred and appropriate, refund the purchase price.

Unless otherwise required by law, postage and packaging charges are not refundable and return postage costs are the customer's responsibility.

Customers should obtain proof of postage when returning items, as Swim-With-Me cannot accept responsibility for items lost during return transit.

Nothing in these terms affects your statutory rights.

Force Majeure

Swim-With-Me will not be responsible for failure or delay in providing services where this results from circumstances beyond our reasonable control.

These circumstances may include, but are not limited to:

fire, flood, earthquake, extreme weather or other natural disasters;
pandemic, epidemic or similar public-health events;
terrorist attack, civil disturbance, civil war or riots;
mandatory compliance with laws, regulations or instructions from an appropriate authority;
explosion or accidental damage;
building closure or structural failure;
failure of plant, machinery, computers or vehicles;
strikes, industrial action or other labour disputes; or
interruption or failure of electricity, gas, water or other essential utilities.

Where circumstances beyond our reasonable control make it impossible to provide all or part of a service within a reasonable period, the customer's liability will be limited to services already supplied and any other charges properly incurred.

Pricing and Errors

We take reasonable care to ensure that prices, product descriptions and specifications are accurate.

Where an error or omission occurs, Swim-With-Me reserves the right to correct it.

We reserve the right to change our prices from time to time. Any price change will apply to future purchases, renewals or, where applicable, recurring payments after appropriate notice has been provided. A price change will not alter the price of a block that has already been purchased.

Insurance

Swim-With-Me Ltd holds corporate company insurance covering swimmers while participating in Swim-With-Me lessons within the areas applicable to our activities.

This cover does not extend to areas or activities outside Swim-With-Me's responsibility.

Any accident occurring outside the area controlled by Swim-With-Me should be reported to the appropriate venue or responsible organisation.

Payment Security

Swim-With-Me is committed to protecting customers when making online payments.

Online transactions are processed securely through our authorised payment provider, Stripe Payments.

Secure technology is used to protect payment information during online transactions.

Safeguarding and Child Protection

Swim-With-Me instructors are DBS checked and receive appropriate Safeguarding Children and Vulnerable Adults training.
Photography and video recording by customers or visitors is strictly prohibited unless prior written permission has been provided by Swim-With-Me.
Parents and guardians must ensure swimmers use the appropriate changing facilities provided.
Changing poolside is strictly prohibited.
Children aged 8 years and above must use the appropriate changing room in accordance with the rules applicable at the venue.

Customers must also comply with any additional safeguarding and changing-room requirements imposed by individual venues.

Swim-With-Me Photography and Video

Swim-With-Me may occasionally take photographs or video recordings during lessons for marketing, promotional or training purposes.

Parents and guardians will be provided with an opportunity to opt out where applicable.

Where consent is required, photography or video will be managed in accordance with Swim-With-Me's applicable consent procedures and Privacy Policy.

Unless otherwise stated, content published by Swim-With-Me, including website content, documents and other publications, is owned by or licensed to Swim-With-Me Ltd.

We may update these Terms & Conditions from time to time. Any changes will be published on this page together with the revised date.
